McPhillamys Federal Court ruling
Today’s Federal Court ruling setting aside the Commonwealth’s 2024 cultural heritage declaration affecting Regis Resources’ McPhillamys Gold Project in New South Wales is a welcome win for common sense.
In 2024, a fully approved gold mining project worth over a billion dollars in new investment for NSW was blocked as a result of federal ministerial intervention on behalf of activists opposed to the proposed mine.
The Federal Court has found this decision ‘lacked procedural fairness’.
“This is a stark example of how seemingly endless opportunities for activists to disrupt and delay projects continue to cost NSW investment, jobs and growth,” NSW Minerals Council CEO said today.
“This whole sorry saga should be a warning to governments at all levels that their assessment processes are too complicated, too inconsistent, and too vulnerable to spurious challenges and objections.”
